Founder Bonii's Story

S.A.V.E. Kaylee is a not-for-profit organization founded by Bonii Dyjasek in response to her family’s experience with the judicial system. Bonii and her daughter came to believe that her two-year-old granddaughter Kaylee’s biological father was sexually abusing her. Their suspicions were confirmed when Kaylee was brought into the ER after midnight, while on visitation by her father. She was bleeding from a 2 cm tear in her labia. Ultimately the system did not respond to protect this child. Instead, the system chose to protect the father’s rights to access the child. We have since found that this is very common and is termed the “incest loophole.”1 Krista was forced to turn her two-year-old daughter over once a week, and every other weekend, while Kaylee cried, pleading with her mother not to make her go. C.P.S., police, and family court warned Krista that he would have full custody twenty-four/seven if she were to interfere in his free access to the child.
It was a long and emotional three years of dealing with the three branches of the government. Each seemed to shift the responsibility to the other, none taking accountability for the child’s safety from the crime of incest. It essentially became court ordered, legally condoned, sexual abuse.
CPS threatened Krista that if she made any more reports she would lose custody. Subsequently, in Family Court, Judge Mabel Mayfield refused to allow the torn labia into evidence. Then the Friend of the Court (FOC), oddly enough, acted as an attorney for the father, ignoring what should be in the best interest of the child. Their concern, instead, appeared to be preventing the presentation of any evidence of abuse to the Judge; surprisingly, recommending that the suspect/father continue to have unsupervised visitation with the child.
Further complicating the child’s access to safety was the withholding of evidence by the now former Chief of Police in Berrien Springs, Michigan, as an extension of his inappropriate contact and support of the abusive father. This resulted in the prosecutor’s refusal to put out an arrest warrant for the suspect/father. The evidence withheld from C.P.S. included bloody underwear from the child!
Not only was Bonii Dyjasek fighting to protect her granddaughter but she was dealing with police corruption by the now former police chief. The Police arrested Krista because she refused to hand her daughter over to the abuser. CPS warned Krista of the consequences of making any further reports. She was not allowed to take her daughter to a doctor or therapist of her choosing, but to one chosen by C.P.S., and only with prior permission on each occasion. Week after week, the Family Court, C.P.S, and the Berrien Springs Police prevented her from protecting her own daughter. Instead, she was forced to have her two-year-old dragged from her arms for overnight visits with the suspected abuser.
Slowly but surely, Krista was forced into silence. The distress over her daughter’s suffering became so traumatizing that she was unable to perform her job. Bonii Dyjasek, who is Kaylee’s grandmother, and mother of eight, previously had been a thriving entrepreneur. However, in order to pay the attorney fees, she became forced to sell her real estate property in a distressed market, and lost the family home. Her husband had to carry the entire family responsibility due to Bonii’s distress and desperate attempts to save her grandchild from the abuse.
The family contacted several child advocacy groups, government agencies, and private non- profits that were unable and/or unwilling to help protect Kaylee, and the prosecutor refused to pursue the case.
With nowhere to turn, our founder Bonii Dyjasek decided to videotape some of the exchanges, which she then sent to the “Dr Phil” television show. The show contacted the litigants on both sides and they subsequently taped four shows pertaining to this case. Finally, a shocking conclusion to the case will be aired on the Dr Phil Show either Late 2008 or early 2009.
This process included taking a polygraph (lie detector) test for all parties, which the father failed by Howard Swabash (www.abcpolygraph.com). The corrupt Chief of Police arranged for him to take another test, through the Michigan State Police, which he claimed to have passed. However, upon examination by the former President of the American Polygraph Association, it proved to be deceptive.
And now the former Michigan State Police polygraph examiner no longer works for State Police details of this development will be inserted at a later date.
Sadly, during this process, Krista and her mother Bonii were accused of “coaching” two year old Kaylee to cry and scream, and accuse the father of sexual abuse; a not uncommon response by those unfamiliar with the realities and statistics of child sexual abuse. In reality, it would be extremely difficult, if not impossible, to get a child that young to react so strongly against someone if they were not mistreating her.
When Bonii and her daughter returned from the Dr Phil show, they were flooded with calls and emails from people relaying similar stories of abuse, and their local CPS, police and Family Court system’s failure to protect their children from incestuous assaults by their own parent, mostly biological fathers; and in turn failing to protect the protective parent, mostly mothers. In the majority of cases mothers and grandmothers were accused of coaching and abusing their children by reporting what their local police, CPS and/or Family courts deemed false reports without any testing of the perpetrators or mothers by polygraphs or psychosexual examinations. Instead, it seemed that it was easier for them just to make blanket statements that it was a divorce or custody issue. The very reason for the divorce or for one parent to seek custody may well be the issue of sexual abuse, yet the authorities seem ignorant to this possibility.
These complicated cases are swept under the rug by all three prongs of our judicial system that should be available, and act as a fail-safe program. It is important to note that when one of these systems within the whole believes the child, it is difficult if not impossible to convince the others to protect the child. Instead our system ends up being a pass the buck system, so that no one is ultimately held responsible and the perpetrator is given the message that he may not molest stranger’s children but incest is not stopped. His own victims, by way of family court, with the enforcement of his rights by police and sheriff departments, and condoned by a system ironically called “Child Protective Services." The fathers are given financial support by father’s rights groups to assist him in keeping access to his child, which in normal circumstances would be appropriate, but sexual abusers know how to manipulate these laws. Society’s denial is so deep it also assists the abuser in oppressing the protective parent.
It was then that Bonii decided that the system obviously does not work. She wanted to do everything she could to help mothers become aware enough to navigate the system and offer support in anyway possible. As a not-for-profit, we would like to offer resources to mothers of incest victims, or to fathers protecting their children from being prey to a stepfather or other father figure. Our ultimate goals are different from any other child advocacy group in that we fund raise to pay attorneys and private investigators directly, because in all the responses from mothers in these cases it seems that pro bono attorneys are difficult to qualify for, if they can be located. Then, finding one that will do the necessary work in these complicated cases is almost unheard of. S.A.V.E. Kaylee wants to assist a parent or legal guardian in protecting children. We believe advocating for children is the most important task an adult has in this world and are willing to stand strongly behind our belief with 75% of our money going to our cases, with 15% to fundraising to offer these resources and 10% to necessary administration.
